PURPOSE AND SCOPE<\/h2>\n<p>These Terms and Conditions govern access to and use of ancestrina.com and, where applicable, the electronic contracting of products, services, courses, digital resources, books or other offers made directly by ANCESTRINA through the website.<\/p>\n<p>They also establish general rules applicable to forms, accounts, communications, intellectual property, payments, electronic transactions, consumer service and other relationships generated through the website.<\/p>\n<p>Certain services or products may be subject to additional specific conditions. When they exist, they will be disclosed before contracting and will form part of the applicable agreement. In the event of a conflict, the specific condition will prevail with respect to the particular matter, without prejudice to non-waivable consumer rights.<\/p>\n\n<h2>3. GENERAL LEGAL FRAMEWORK<\/h2>\n<p>These Terms are interpreted in accordance with applicable Colombian law, including, where relevant:<\/p>\n<ul>\n<li>Law 1480 of 2011 \u2014 Consumer Protection Statute, as amended, including Law 2439 of 2024 on consumer protection in ecommerce;<\/li>\n<li>Law 527 of 1999 on data messages, electronic commerce and formation of contracts by electronic means;<\/li>\n<li>Decree 1074 of 2015 and the regulations applicable to distance sales, ecommerce and payment reversal;<\/li>\n<li>Law 1581 of 2012 and its regulations regarding personal-data protection;<\/li>\n<li>Law 1335 of 2009, as amended among others by Law 2354 of 2024, where tobacco, nicotine or other regulated categories are involved;<\/li>\n<li>other special rules applicable according to the nature of the product or service.<\/li>\n<\/ul>\n<p>No provision of these Terms is intended to limit rights that are legally non-waivable.<\/p>\n\n<h2>4. ACCEPTANCE AND ELECTRONIC CONTRACTING<\/h2>\n<p>General access to the website requires compliance with the applicable rules of use. INDIVIDUAL THERAPEUTIC ACCOMPANIMENT<\/h2>\n<p>ANCESTRINA offers an Individual Therapeutic Accompaniment service whose description, format, modality, responsible professional, duration, price and other current conditions must be disclosed on the relevant page before contracting.<\/p>\n<p>Contracting a process does not imply a guarantee of a specific result. The course of a process depends on multiple factors that cannot be contractually promised as assured outcomes.<\/p>\n<p>These Terms do not replace informed consents, service agreements, scheduling rules, personal-data documents or specific conditions applicable to a particular process.<\/p>\n\n<h2>9. COUPLE THERAPY OR COUPLE ACCOMPANIMENT<\/h2>\n<p>Services for couples will be provided under the specific conditions disclosed before the process begins. Contracting does not imply a promise of reconciliation, continuation of the relationship, restoration of trust, prevention of separation or any predetermined relational result.<\/p>\n<p>Where there is information about violence, threats, coercion or risk, ANCESTRINA may require a different review before offering or continuing a couple service and may indicate that another form of care is more appropriate.<\/p>\n<p>Initial couple forms do not replace a professional assessment and do not constitute an emergency service.<\/p>\n\n<h2>10. THE WEBSITE IS NOT AN EMERGENCY SERVICE<\/h2>\n<p>ANCESTRINA\u2019s forms, email, WhatsApp and other channels are not emergency-care services and do not guarantee an immediate response.<\/p>\n<p>If a person is in immediate danger, there is urgent risk to them or another person, or immediate medical or psychiatric care is required, they should contact the emergency services available in their location or attend the appropriate emergency facility.<\/p>\n\n<h2>11. COURSES, PROGRAMS AND DIGITAL RESOURCES<\/h2>\n<p>ANCESTRINA may offer prerecorded courses, live programs, masterclasses, downloadable materials or other educational resources. Before purchase, each offer must state, as applicable:<\/p>\n<ul>\n<li>content or general scope;<\/li>\n<li>format;<\/li>\n<li>modality;<\/li>\n<li>duration or access period where applicable;<\/li>\n<li>price;<\/li>\n<li>start date where applicable;<\/li>\n<li>relevant technical requirements;<\/li>\n<li>whether access is immediate;<\/li>\n<li>applicable cancellation, statutory withdrawal or refund conditions.<\/li>\n<\/ul>\n<p>Courses and educational content do not automatically replace an individualized therapeutic process when such a process is needed.<\/p>\n\n<h2>12. The existence of this area within the same website does not mean that ancestral practices automatically form part of individual or couple therapeutic services.<\/p>\n<p>Rap\u00e9 may vary in composition depending on the preparation. When it contains tobacco or nicotine, it must be treated as a product subject to the applicable risks and restrictions. ANCESTRINA does not contractually present it as a medical treatment, cure or universal solution.<\/p>\n<p>Specific commercial conditions for regulated products will be subject to applicable law and to the relevant sale, advertising, age, shipping or destination restrictions.<\/p>\n\n<h2>14. INFORMATION ABOUT PRODUCTS AND SERVICES<\/h2>\n<p>ANCESTRINA will seek to provide truthful, reliable, sufficient, clear and current information that allows consumers to form a reasonable understanding of the product or service before contracting.<\/p>\n<p>Depending on the nature of the offer, the information may include:<\/p>\n<ul>\n<li>characteristics;<\/li>\n<li>components or ingredients where applicable;<\/li>\n<li>quantity or presentation;<\/li>\n<li>origin or provenance where relevant and verifiable;<\/li>\n<li>method of use and relevant restrictions;<\/li>\n<li>features included in a service;<\/li>\n<li>availability;<\/li>\n<li>duration of an offer;<\/li>\n<li>specific access or service conditions.<\/li>\n<\/ul>\n<p>Photographs are illustrative, but must not be used in a way that creates a materially misleading representation of the product.<\/p>\n\n<h2>15. Those charges must be distinguished from charges directly established by ANCESTRINA.<\/p>\n\n<h2>17. OBVIOUS PRICE OR INFORMATION ERRORS<\/h2>\n<p>If there is an obvious and objectively recognizable error in price, availability or essential information, ANCESTRINA may temporarily suspend the transaction in order to verify it. If the transaction cannot lawfully be fulfilled under the information provided, the situation will be communicated and the corresponding refund will be made where appropriate, without using this clause to disregard validly accepted offers or consumer rights.<\/p>\n\n<h2>18. Full card data and security codes must not be stored directly by ANCESTRINA unless infrastructure expressly enabled and legally appropriate for doing so exists.<\/p>\n\n<h2>21. DELIVERY OF PHYSICAL PRODUCTS<\/h2>\n<p>The delivery period accepted by the consumer must be disclosed before the transaction is completed. Where no other applicable period has been established, the limits provided by Colombian ecommerce law will be observed.<\/p>\n<p>Shipping conditions, carriers, serviced areas, costs, tracking, incidents, unavailable products and other operational rules are set out in the <a href=\"\/en\/return-shipments-policy-returns-refunds\/\">Shipping, Exchanges, Returns, Withdrawal and Refund Policy<\/a>.<\/p>\n\n<h2>22. RIGHT OF WITHDRAWAL (RETRACTO)<\/h2>\n<p>Where the right of withdrawal applies under Article 47 of the Colombian Consumer Protection Statute and other current rules, the consumer may exercise it within the statutory period and subject to the applicable conditions.<\/p>\n<p>The law establishes exceptions, including certain services whose performance has begun with the consumer\u2019s agreement and certain categories of goods that, because of their nature, customization, deterioration, expiration or personal-use character, are legally excluded.<\/p>\n<p>Where a refund arising from withdrawal applies, ANCESTRINA will comply with the current statutory refund period once the consumer has fulfilled the applicable obligations.<\/p>\n<p>The detailed procedure is set out in the <a href=\"\/en\/return-shipments-policy-returns-refunds\/\">Shipping, Exchanges, Returns, Withdrawal and Refund Policy<\/a>.<\/p>\n\n<h2>23. PAYMENT REVERSAL<\/h2>\n<p>Where the statutory conditions for reversing payments made through ecommerce and electronic payment instruments are met, the consumer may use the procedure provided by Colombian law.<\/p>\n<p>Depending on the circumstances, legally recognized grounds may include:<\/p>\n<ul>\n<li>fraud;<\/li>\n<li>an unauthorized transaction;<\/li>\n<li>product not received;<\/li>\n<li>product delivered does not correspond to what was ordered;<\/li>\n<li>defective product.<\/li>\n<\/ul>\n<p>A payment-reversal request requires compliance with the periods and steps before the provider and the issuer of the payment instrument established by current law. The operational procedure will be set out in the English version of the Consumer Service \u2014 PQR, Warranties and Payment Reversal document once that translation has been reviewed and published.<\/p>\n\n<h2>24. WARRANTIES<\/h2>\n<p>Products subject to the statutory warranty will be governed by the Colombian Consumer Protection Statute and by the specific information provided for the relevant category.<\/p>\n<p>ANCESTRINA will not use these Terms to exclude a mandatory warranty. Conditions and claim channels are provided on the Consumer Service page; its English legal version is pending review\/publication.<\/p>\n\n<h2>25. CANCELLATIONS AND RESCHEDULING OF SERVICES<\/h2>\n<p>Cancellation or rescheduling rules for sessions, events, live programs or other services must be displayed clearly before contracting when they are relevant to the consumer\u2019s decision.<\/p>\n<p>Commercial scheduling conditions may not be interpreted in a way that eliminates non-waivable rights recognized by law.<\/p>\n\n<h2>26. DIGITAL CONTENT AND ACCESS<\/h2>\n<p>Where a purchase grants access to digital content, the user receives a personal authorization to access that content under the conditions disclosed for the product. INTELLECTUAL PROPERTY<\/h2>\n<p>Unless otherwise stated, texts, courses, videos, designs, trademarks, logos, photographs, educational materials and other proprietary content on the site are protected by applicable intellectual-property rules and belong to ANCESTRINA, Marcela G\u00f3mez, V\u00edctor Silva or the identified rights holder.<\/p>\n<p>Access to the website does not grant a general license to copy, transform, distribute, sell or commercially exploit such content.<\/p>\n\n<h2>29. TRADEMARKS AND DISTINCTIVE SIGNS<\/h2>\n<p>ANCESTRINA and other distinctive signs used on the site may not be used in a way that suggests sponsorship, affiliation or authorization that does not exist.<\/p>\n\n<h2>30. THIRD-PARTY CONTENT AND LINKS<\/h2>\n<p>The site may link to platforms, payment services, social networks, video services, carriers, authors, research or other third parties.<\/p>\n<p>When the user leaves ancestrina.com, the third party\u2019s terms may apply to that interaction. TECHNICAL AVAILABILITY OF THE WEBSITE<\/h2>\n<p>ANCESTRINA will seek to keep the website available, but interruptions may occur because of maintenance, third-party failures, security, connectivity, force majeure or technical causes. Where an interruption affects a paid service, the corresponding contractual and legal obligations will apply.<\/p>\n\n<h2>34. LIMITATION OF LIABILITY<\/h2>\n<p>Within the limits permitted by law, ANCESTRINA will not be responsible for damages arising exclusively from misuse of the website, breach by the user, false information provided by the user or acts of third parties over whom ANCESTRINA has no legal or contractual control.<\/p>\n<p>This clause does not exclude liability where the law does not permit exclusion, nor does it limit warranties, security duties, information obligations, consumer rights or ANCESTRINA\u2019s own responsibilities.<\/p>\n\n<h2>35. PERSONAL DATA AND COOKIES<\/h2>\n<p>Personal-data processing is governed by:<\/p>\n<ul>\n<li><a href=\"\/en\/privacy-policy\/\">Personal Data Processing and Privacy Policy<\/a>;<\/li>\n<li><a href=\"\/en\/cookie-policy\/\">Cookie and Tracking Technologies Policy<\/a>.<\/li>\n<\/ul>\n<p>Acceptance of these Terms does not replace specific personal-data or marketing authorizations that must be requested separately.<\/p>\n\n<h2>37. ELECTRONIC COMMUNICATIONS<\/h2>\n<p>Communications related to a transaction, contracted service, security matter, order or request may be sent through the channels provided by the user and will be considered operational communications.<\/p>\n<p>Promotional communications will require the applicable authorization and must allow the recipient to opt out where relevant.<\/p>\n\n<h2>38. CONSUMER-PROTECTION AUTHORITY<\/h2>\n<p>The site must maintain a visible and easily identifiable link to the Colombian consumer-protection authority, in accordance with the obligations applicable to ecommerce.<\/p>\n<p>Authority: Superintendencia de Industria y Comercio (SIC).<\/p>\n\n<h2>41. APPLICABLE LAW AND DISPUTES<\/h2>\n<p>These Terms are governed by the laws of the Republic of Colombia, without prejudice to mandatory consumer-protection rules that may apply to an international transaction.<\/p>\n<p>Before using available administrative or judicial mechanisms, the consumer may use ANCESTRINA\u2019s direct channels. Where the law requires a prior direct claim, the applicable procedure must be followed.<\/p>\n<p>Nothing in these Terms requires a consumer to waive in advance any authority, action or right legally available to them.<\/p>\n\n<h2>42. CHANGES TO THE TERMS<\/h2>\n<p>ANCESTRINA may update these Terms when its services, operations, technology or legal framework change.
